Terms of Use

1. Acceptance of Terms
By downloading, installing, accessing, or using the HomeBit mobile application ("App"), website, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Services.
These Terms constitute a legally binding agreement between you and HomeBit, Inc. ("HomeBit," "we," "us," or "our") regarding your use of the Services. Please read these Terms carefully.
2. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms within the App or on our website, and/or by sending you a notification through the App. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.
3. Eligibility and Account Registration
3.1 Age Requirement
You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials, including your phone number and any authentication codes. You agree to notify us immediately of any unauthorized access to or use of your account. HomeBit will not be liable for any loss or damage arising from your failure to comply with this security obligation.
4. Use of Services
4.1 License
Subject to your compliance with these Terms, HomeBit grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on devices that you own or control.
4.2 Prohibited Conduct
You agree not to:
- Use the Services for any illegal purpose or in violation of any local, state, national, or international law
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
- Interfere with or disrupt the Services or servers or networks connected to the Services
- Attempt to gain unauthorized access to any portion of the Services or any other accounts, computer systems, or networks connected to the Services
- Upload or transmit viruses, worms, Trojan horses, or other harmful code
- Collect or harvest any personally identifiable information from the Services
- Use automated means, including spiders, robots, crawlers, or data mining tools, to download or scrape data from the Services
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App or Services
5. Subscriptions and In-App Purchases
5.1 Subscription Tiers
HomeBit offers a free tier and the following paid offerings (prices in U.S. dollars; current pricing is always shown on the in-app paywall before purchase):
- HomeBit Plus — auto-renewing subscription. $9.99/month or $99/year. Includes everything in the free tier plus Auto Cost Tracking (bank/email integration), Home Value Tracking (Redfin & Zillow), AI Bill Negotiation, and Premium Partner Perks.
- HomeBit Hero — physical home-services add-on. $29.99/month or $299/year. Includes Plus features plus 1–2 monthly Fix-It Visits (light bulbs, batteries, filters, and similar light-touch tasks) and Box Haul-Away (Amazon & cardboard pickup and recycling). Hero is a real-world services product and is billed by HomeBit directly through Stripe (see §5.5), not through the Apple App Store or Google Play.
HomeBit may add, modify, or retire subscription tiers and features. Changes that affect existing paid subscribers will be announced in advance under §5.6.
5.2 Free Trial
HomeBit Plus and HomeBit Hero each include a 30-day free trial for first-time subscribers. The trial converts automatically to a paid subscription at the listed price unless you cancel at least 24 hours before the trial ends. If you cancel during the trial, you will not be charged. If you start a paid subscription before your trial ends, any unused portion of the free trial is forfeited. Trial eligibility may be limited to one free trial per user, per Apple ID, or per Google account.
5.3 Auto-Renewal — Apple App Store (iOS)
For HomeBit Plus subscriptions purchased through the Apple App Store, the following terms apply:
- Payment will be charged to your Apple ID account at confirmation of purchase.
- Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen package.
- You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
- No cancellation of the current subscription period is allowed during an active subscription period.
5.4 Auto-Renewal — Google Play (Android)
For HomeBit Plus subscriptions purchased through Google Play, payment is charged to your Google Play account at confirmation of purchase and renews automatically at the listed price each billing period until canceled. You can manage or cancel your subscription at any time at play.google.com/store/account/subscriptions or in the Google Play app under Subscriptions. Cancellation takes effect at the end of the then-current billing period; you retain access to paid features through that date.
5.5 HomeBit Hero Billing (Stripe)
HomeBit Hero is a real-world home-services product (Fix-It Visits and Box Haul-Away) and is sold and billed by HomeBit directly through Stripe, our payment processor. Hero is not a digital subscription processed through the App Store or Google Play. By purchasing Hero, you authorize HomeBit (via Stripe) to charge your selected payment method (Apple Pay, Google Pay, or credit/debit card) for the listed price each billing period until you cancel. Stripe receives and processes your payment-card information; HomeBit does not store full card numbers. You can cancel Hero at any time in the app under Subscription or by emailing support@homebit.com.
5.6 Price and Plan Changes
We may change subscription prices, billing periods, or features. We will notify you of any renewal-price increase or material change at least 30 days before it takes effect, by in-app notice and/or email to the address associated with your account. If you do not cancel before the change takes effect, your continued use of the paid subscription after the effective date constitutes acceptance of the new price or terms.
5.7 Refunds
- Plus (App Store): Refund requests for HomeBit Plus subscriptions purchased through the Apple App Store must be submitted to Apple at reportaproblem.apple.com. HomeBit cannot issue refunds for purchases made through Apple.
- Plus (Google Play): Refund requests for HomeBit Plus subscriptions purchased through Google Play are governed by Google's refund policy at support.google.com/googleplay/answer/2479637. HomeBit cannot issue refunds for purchases made through Google.
- Hero (Stripe): Hero is non-refundable for the current billing period. Cancellation stops future renewals but does not refund the current period. If a scheduled Fix-It Visit or Box Haul-Away cannot be completed due to HomeBit's failure to perform, contact support@homebit.com for a service credit.
5.8 Restoring Purchases
If you reinstall the App or sign in on a new device, you can restore eligible purchases by tapping Restore Purchases in the app's Subscription screen.
6. Apple App Store EULA Addendum
The terms in this Section 6 apply only when you obtain the App from the Apple App Store and are required by Apple's Schedule 2 to the Paid Applications Agreement and Exhibit D thereto.
- Acknowledgement. These Terms are concluded between you and HomeBit, not with Apple Inc. ("Apple"). HomeBit, not Apple, is solely responsible for the App and its content.
- Scope of License. The license granted to you for the App is a limited, non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing if and when HomeBit enables those features.
- Maintenance and Support. HomeBit is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish maintenance or support for the App.
- Warranty. HomeBit is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are HomeBit's sole responsibility.
- Product Claims. HomeBit, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual Property Rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, HomeBit, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
- Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Developer Contact. Questions, complaints, or claims regarding the App should be directed to HomeBit at legal@homebit.com or the address in §17 below.
- Third-Party Terms. You must comply with applicable third-party terms when using the App (for example, your wireless data service agreement).
- Third-Party Beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
- U.S. Government End Users. The App and related documentation are "Commercial Items," as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. The App is licensed to U.S. Government end users only as Commercial Items and with only those rights as are granted to all other end users under these Terms.
7. User Content
7.1 Your Content
You retain ownership of any content you upload, submit, store, or send through the Services ("User Content"). By providing User Content, you grant HomeBit a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with providing and promoting the Services.
7.2 Responsibility for Content
You are solely responsible for your User Content and represent and warrant that you have all necessary rights to provide such content and that your User Content does not violate any third-party rights or applicable laws.
8. Third-Party Services and Links
The Services may contain links to third-party websites, services, or resources, including contractor referrals and home service providers. We are not responsible for the content, products, or services provided by third parties. Your interactions with third parties are solely between you and the third party.
9. Disclaimers
9.1 As-Is Basis
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
9.2 No Professional Advice
HomeBit does not provide professional home inspection, legal, tax, or financial advice. Information provided through the Services is for general informational purposes only and should not be construed as professional advice.
9.3 Contractor Referrals
Any contractor referrals provided through the Services are for informational purposes only. HomeBit does not endorse, guarantee, or warrant the work of any contractor or service provider. You are solely responsible for vetting and selecting contractors.
9.4 Paid Features Disclaimer
HomeBit Plus, HomeBit Hero, and any other paid features are provided as-is. To the maximum extent permitted by law, HomeBit shall not be liable for claims, damages, losses, or issues arising from your use of any paid feature, except as expressly required under §5.7 (Refunds) or applicable consumer-protection law.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HOMEBIT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
- ANY CONTENT OBTAINED FROM THE SERVICES
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
IN NO EVENT SHALL HOMEBIT'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID TO HOMEBIT FOR USE OF THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100.00), WHICHEVER IS GREATER.
11. HomeBit Hero Add-on
The HomeBit Hero Add-on ("Hero Add-on") is an optional premium service that bundles in-person home services with the digital features of HomeBit Plus. Pricing, billing, free-trial, refund, and cancellation terms for Hero are described in §5 (Subscriptions and In-App Purchases) and apply in addition to the operational terms below.
11.1 Availability
The Hero Add-on is currently available only in select geographic areas as determined by HomeBit in its sole discretion. HomeBit may expand, modify, or reduce the geographic availability of the Hero Add-on at any time. If Hero becomes unavailable in your area while you are an active subscriber, HomeBit will pause future renewals and notify you by in-app notice and/or email.
11.2 Service Scope
Fix-It Visits cover light-touch tasks (such as changing light bulbs, batteries, and air filters) up to the monthly visit limit shown in the App. Hero does not cover plumbing, electrical, structural, hazardous-material, or any work requiring a licensed contractor. Box Haul-Away covers Amazon and ordinary cardboard packaging only. HomeBit may decline tasks that are unsafe, outside the published scope, or otherwise inappropriate at our reasonable discretion.
11.3 Feature Modifications
HomeBit may modify, add, or remove features included in the Hero Add-on. Material changes that affect existing subscribers will be communicated under §5.6 (Price and Plan Changes), and you may cancel before the change takes effect.
11.4 User Responsibility
You are responsible for providing safe access to your home, accurate scope information, and any consents required from co-occupants or property owners. HomeBit is not responsible for pre-existing damage, items not requested for service, or losses arising from inaccurate access information you provide.
12. Class Action Waiver and Arbitration
12.1 Binding Arbitration
YOU AND HOMEBIT AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES ("Dispute") WILL BE RESOLVED EXCLUSIVELY THROUGH BINDING ARBITRATION, EXCEPT THAT YOU MAY ASSERT CLAIMS IN SMALL CLAIMS COURT IF YOUR CLAIMS QUALIFY.
12.2 Class Action Waiver
IMPORTANT: PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS.
YOU AND HOMEBIT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, PRIVATE ATTORNEY GENERAL ACTIONS, AND CONSOLIDATION WITH OTHER ARBITRATIONS. The arbitrator may not conduct class arbitration or consolidate more than one person's claims without the written consent of all parties.
12.3 Arbitration Rules
The arbitration will be administered by the American Arbitration Association (AAA) in accordance with the Commercial Arbitration Rules and Mediation Procedures then in effect. The arbitration will be conducted in English in the county where you reside or in Travis County, Texas, at your option.
12.4 Opt-Out
You may opt out of this arbitration agreement and class action waiver by sending written notice of your decision to opt out to: HomeBit Legal, 14425 Falcon Head Blvd Bldg E, Suite 100, Austin, TX 78738, or by email to legal@homebit.com within 30 days of first accepting these Terms.
13. Indemnification
You agree to defend, indemnify, and hold harmless HomeBit and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another.
14. Termination
HomeBit reserves the right to terminate your account or paid subscription at any time, for any reason, without prior notice or liability. This includes, but is not limited to, termination for violation of these Terms, non-payment, fraud, or any other reason at HomeBit's sole discretion. If we terminate a paid subscription without cause, we will refund the unused portion of any prepaid period that you paid HomeBit directly (Hero); subscriptions billed by Apple or Google are governed by those platforms' refund policies (see §5.7).
We may also terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
16. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Services and supersede and replace any prior agreements we might have had between us regarding the Services.
